Definition of Stalking

Definition of a stalker is someone who contacts you with unwarranted and unwanted emails, phone calls, texts, blogs posts, facebook posts etc, etc. Someone who trolls you, harasses you. You ask them to stop, you block them but months on they still find the need to send you abuse and try to make your life as miserable as possible. What you do is try hard to ignore the insults. Don’t get angry no matter what the insults, try not to play their silly game and hope they give up and find something else to do with their sad lives. Their behaviour can at times be irrational, confusing, immature, self defeating, spiteful and frankly nonsensical. If they don’t stop for whatever reason you then draw a line and once it has been crossed you set about stopping them. You have a number of options but the Police are probably your best bet really, as he/she doesn’t get too many warnings before strong action occurs if they persist. A civil injunction is another option or a combination of the two might be suitable. It will stop them one way or the other. Once they go away you can happily get on with your lives. From a personal point of view I would be happy to move on, wipe the slate clean but if it continues you simply can’t let them get away with it. Always use facts in any correspondence you post. From a legal standpoint it is a must. A stalker can be an absolute pain in the backside. They don’t seem to have any ability to reason, they are lost in their own little worlds which are meaningless and want to make you unhappy because they are not happy in their own lives. They like to have an opinion on you, your work, your family etc which is neither right or wanted. If you do get a stalker don’t take them lightly and don’t put up with them either! It is worth remembering that mental illness and life instability plays a major role in stalking with many portraying psychotic tendancies

Below are the legal terms under which stalking can come.

United Kingdom

Already before the enactment of the Prevention from Harrassment Act, the Malicious Communications Act 1988 and the Telecommunications Act 1984 (now the Communications Act 2003) criminalised indecent, offensive or threatening phone calls and the sending of an indecent, offensive or threatening letter, electronic communication or other article to another person. Before 1997 no specific offence existed in England and Wales but in Scotland incidents could be dealt with under pre-existing law with life imprisonment available for the worst events.

England and Wales

In England and Wales, “harassment” was criminalised by the enactment of the Protection from Harassment Act 1997, which came into force on June 16, 1997. It makes it a criminal offence, punishable by up to six months imprisonment, to pursue a course of conduct which amounts to harassment of another on two or more occasions. The court can also issue a restraining order, which carries a maximum punishment of five years imprisonment if breached. In England and Wales, liability may arise in the event that the victim suffers either mental or physical harm as a result of being harassed (or slang term stalked) (see R. v. Constanza).

In 2012, the Prime Minister David Cameron stated that the government intended to make another attempt to create a law aimed specifically at stalking behaviour.[47]
